AGED MAN SHOT BY HIS FRIEND

In Hospital After Being Mistaken for Thief in Early Morning

As he walked around the home of James H. Eddy, 2722 Dublin street, in search of burglars at 3:45 a. m. yesterday, William Ebberman, 65 years old, of 2634 Dublin street, was mistaken for a thief and shot in the left leg near the knee by Eddy.
The Eddy family had been absent from the city and each morning Ebberman would examine the doors of the house. Eddy is said to have returned unexpectedly Sunday night and failed to notify the aged man of his return.
While Ebberman examined the front door, Eddy was awakened, believed a burglar was about to enter his home, grabbed his revolver, saw the form of a man walking in the dark alley, called to him to halt and then fired one shot, which struck the aged man in the leg.
At Charity hospital Ebberman told police he did not hear Eddy call to him to halt. Police who investigated said Eddy will not be prosecuted, the shooting having clearly been an accident.
