County, Virginia In the name of God Amen I Vincent Garner of the Parish of St. Stephens in the County of Northumberland Carpenter being sick and weak in body but of sound and perfect memory thanks to Almighty God for the same but calling to mind the uncertain Estate of Transitory Life that all mankind must yield unto death when it shall please God to call them doo make & ordain this my Last Will & testament revoking by these presents annulling all former Will or Wills Testament or Testaments by me heretofore made or caused to be made either by word or writing notifieing and confirming this to be my last will and none other first and principally I bequeath my Soule to God that gave it me trusting in and through the meritts of my blessed Savior and Redeemer to receive full pardon & Remission of all my Sins and Everlasting Life after death and my body to the Earth to be buryed after a decent & Christianlike manner at the direction of my Exetor hereafter nominated and as touching such worldly Estate as it hath pleased God beyond my Deserves to bestow upon me I give devise and dispose of in manner and form following (vizt.) Item - Whereas I have a certain platt of land which I purchased of Henry Duncan and Dorothy his wife it being the land whereon I now live I give and devise the same unto my sons Vincent Garner and James Garner and their heirs Lawfully to be begotten of their bodies and to be divided as followeth (vizt.) the dividing line to begin at a branch called Gaymore branch thence by a Valley to a saw pitt thence to another saw pitt standing in another Valley near to the forrest Valley and thence down the said Valley untill it comes to the main Swamp that leads to Dawsons Mill Dam the Plantation and land on that side of the line to my son Vincent and if my said sons should die without heirs as aforesaid I give and devise the said land unto my three daughters Anne, Jane, and Martha Garner and their heirs lawfully to be begotten of their bodies and for default of such heirs I devise the same unto my Brother Parish Garner and his heirs forever. Item - I give and devise unto my said sone James Garner and his heirs forever that parcell of Land I bought of Frankie Dawson. Item - I give my daughter Anne Garner and her heirs forever the Plantation Land and appurtenances Whereon my Mother now lives which said land was devised to me by my father John Garner deceased. Item - I give to my said daughter Ann and her heirs forever that platt of land purchased of John Jenkins lieing in hornspoint in Westmoreland County. Item - I give to my said daughter Ann one small silver tankard. Item - I give unto my daughter Jane a small silver tankard. Item - I give unto my said son Vincent one small gun called five & twenty. Item - another small gun I give unto my sone James Garner. Item - all the rest of my estate personall after my just debts paid I give and bequeath unto my loving wife, Martha Garner and my children Vincent Garner, James Garner, Anne Garner, Jane Garner, Martha Garner equally to be divided and my will is that both of my sons have three years schooling beginning at ten yeares of age and continue until thirteen and that my daughters both have two years of schooling beginning at ten and continuing to twelve and that their estate may defray the charges thereof and also my will is that my sons be possessed pf their estates at the age of eighteen yeares and my daughters with theirs at the said age or at the Day of Marriage. I do hereby constitute and ordain my Loveing wife Martha Garner & my Brothers Parish, James, and Benjamin Garner Executors of this my last wille and testament to see the same duly performed and executed to the true intent and meaning hereof. In Witness whereof I have hereunto sett my hand and seale this 30th day of September Anno Domini 1710.
