Before me James G. Parkerson, Recorder and Ex-Officio Notary Public, duly commissioned and sworn in and for the Parish of St. Mary, in presence of the witnesses hereinafter named and undersigned.
Personally came and appeared William T. Potter, a resident of the Parish of St. Mary who declared that he did and does by these presents, Bargain, Sell, Assign, Convey, Set over and Deliver unto James Hughes, likewise a resident of this Parish aforesaid, here present and accepting the following property to wit:
Two certain Town lots known as lots number Forty-two (42) and Forty-three (43) Said number Forty-two measuring Eighty feet front on Second Street by one Hundred feet in depth and Eighty feet front on the back line, and the lot number forty three having a front of seventy feet front on Said Street by a depth of ninety feet and having a front on the back line of fifty feet also one Eighth part of the lot, adjoining Said lot number Forty two to be taken out of the lot number Forty one on the plan of Said Town, from that side of the same which connects the said lots number forty one (41) and forty two (42). Together with all the buildings and improvements thereon situate rights, ways, privileges & appurtenances thereunto belonging, this being the same property as purchased by present Vendor of Thomas Taiffe as per act [illegible] before George B. Shepherd Notary Public under date the 22nd instant.
To have and to hold the Said Conveyed property unto the Said purchaser his heirs and assigns, in full property forever, with full and general warranty of title, free from all liens, mortgages and incumbrances whatever, and with full subrogation to all the rights of warranty and all other rights held into the said property by the present vendor.
This Sale is made for and in Consideration of the price and Sum of Seven Hundred Dollars payable as follows to wit: the Sum of three Hundred and fifty Dollars Cash in hand paid (receipt whereof is hereby acknowledged and good acquitance and discharge given therefor) and for the balance Consequently three Hundred and fifty Dollars payable in one year from the twenty Second day of the present mopth for which the Said Vendee hath made signed and executed his promessory Note falling due at the epoch aforesaid, and made payable to the vendor Conditioned to bear eight per cent per annum interest from Maturity until paid in full. Which note after having been Paraphed Ne Varietur by me, Said Recorder, to be identified with this act, has been remitted to Said Vendor who acknowledges due possession and delivery of the Same.
And in order to Secure Still More effectually the full, punctual and entire payment of the Said Note when the Same Shall become due, according to the Stipulations herein written, and to the tener of Said Note the property herein Conveyed is to be and remain Specially Mortgaged and hypothecated in favor of the Said Vendor, until full and entire payment of the Said Note in principal and interest. The parties agree to dispense with the Certificate required by Article 3328 of the Civil Code of this State, and exonerate me, said Recorder, from all liability on account of the nonproduction of the same.
Tus done and passed at Franklin in the Parish of St. Mary, on this twenty fourth day of August Eighteen Hundred and Fifty Seven, in presence of Robert N. McMillan and Simon Smith, both competent witnesses, who have signed these presents with the said appearers and me, said Recorder, after due reading. William T. Potter, James Hughes, R. N. McMillan, Simon Smith, J. G. Parkerson, Recorder.
